In the present work, Ellet acted "as counsel for the City of Wheeling in the controversy between that city and the Baltimore and Ohio Railroad. The dispute arose over the choice of a proper route for the railroad to follow in entering the City of Wheeling...Ellet's share in the controversy...consisted mainly in the publication of three reports [this is the first] sustaining the position of the City of Wheeling. His task was primarily one of consultation, a role commonly fulfilled by engineers of distinction. Ellet's main argument was to prove to the public and to the board of arbiters selected to settle the dispute that the additional longer route, preferred by the company, would be harmful to the interests of the citizens of Wheeling, who had agreed to aid in the construction and maintenance of the railroad."Lewis, Charles Ellet, Jr. The Engineer as Individualist, pp. 137-38.
